Common use of Minimum Spend Clause in Contracts

Minimum Spend. 2.1 ▇▇▇▇▇▇▇ Haven does not charge the Client on a per capita basis but requires a Minimum Spend from the Client on the day. This Minimum Spend is a fixed fee which is allocated to food, drinks and the service fee. The full Minimum Spend amount (in column 4 of Table 1 above) must be paid no later than 1 (ONE) month prior to the wedding day. Any available surplus on the Minimum Spend after food, welcome drinks, wine, and / or other beverages have been paid for in full, will be utilised as a deposit for an open bar on the night. The Minimum Spend amount is refundable, subject to a reasonable cancellation penalty in terms of section 17 of the Consumer Protection Act, Act 68 of 2008, read with clause 15 of this Agreement. 2.2 The final number of guests as discussed at the final appointment will be the number charged for, unless attendance is greater as detailed above in which case the additional food will be ordered and charged for.
