Common use of Misuse Clause in Contracts

Misuse. ZEISS will not be responsible for Services resulting from misuse of the Equipment, including without limitation (i) any intentional acts or negligence of Customer’s employees, agents, representatives or invitees, (ii) anyone other than ZEISS authorized personnel attempting to repair or service the Equipment, (iii) use of devices not provided or authorized by ZEISS, (iv) misuse of the Equipment, including, without limitation, use of the Equipment for any application or function for which it was not designed, or (v) use of unauthorized software and/or accessories (as defined below in subsection 2.6).
