Common use of Mitigation of Effects of Force Majeure Clause in Contracts

Mitigation of Effects of Force Majeure. As soon as practicable after the notification specified pursuant to Clause 11.3, the Parties shall use reasonable endeavours to agree appropriate terms or modifications to the scope of Service (Annex C (Scope of Service (Technical Specification))) and Service schedule (Annex D (Service Schedule and Rates) to mitigate the effects of the Force Majeure Event and to facilitate the continued performance of this Agreement.
