Mobile App. In the event Customer elects to download and use the Mobile App onto Customer’s handheld device, Customer’s use of the Mobile App shall be in accordance with the terms of this Agreement. Customer and DeepInsights acknowledges that this Agreement is concluded between Customer and DeepInsights only, and not with the Mobile Store, and DeepInsights, not the Mobile Store, is solely responsible for the Mobile App, for all support and maintenance related thereto, for any indemnification obligations described in Section 9.1. The license granted to Customer to use the Mobile App is limited to use on any handheld devices that Customer owns or controls and as permitted by the usage rules or similar rules set forth in the Mobile Store’s terms of service. In the event of any failure of the Mobile App to conform to any applicable warranty herein, Customer may notify the Mobile Store, and the Mobile Store may refund the purchase price for the Mobile App to Customer (if any); and that, to the maximum extent permitted by applicable law, the Mobile Store will have no other warranty obligation whatsoever with respect to the Mobile App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty. Customer acknowledges that the Mobile Store (and its subsidiaries) are third-party beneficiaries of the Agreement and will have the right to enforce it.
