Common use of Modification of License Clause in Contracts

Modification of License. Lessor and Lessee acknowledge the possibility that the location and technical configuration of the MMDS Station may from time to time prevent Lessee from optimizing its wireless cable business throughout the term of this Agreement. Lessor therefore agrees that if at any time and from time to time Lessee so requests in writing, Lessor shall use its best efforts to modify its FCC application(s) or license(s) to meet the reasonable requirements of Lessee. Lessee shall pay all costs associated with such modifications (including engineering and legal fees, equipment costs and construction expenses), as provided in Paragraph 5(f) hereof.
