Common use of Modules Clause in Contracts

Modules. The following modules of the SCCs apply in the manner set out below (having regard to the role(s) of Customer set out in Attachment 1 to Annex 1 (European Annex) to the DPA): (a) Module Two of the SCCs applies to any Restricted Transfer involving Processing of Customer Personal Data in respect of which Customer is a Controller in its own right; and/or (b) Module Three of the SCCs applies to any Restricted Transfer involving Processing of Customer Personal Data in respect of which Customer is itself acting as a Processor on behalf of any other person.

The following modules of the SCCs apply in the manner set out below (having regard to the role(s) of Customer Client set out in Attachment 1 to Annex 1 (European Annex) to the DPA): (a) Module Two of the SCCs applies to any EU Restricted Transfer involving Processing of Customer Client Personal Data in respect of which Customer Client is a Controller in its own right; and/or (b) Module Three of the SCCs applies to any EU Restricted Transfer involving Processing of Customer Client Personal Data in respect of which Customer Client is itself acting as a Processor on behalf of any other person.
