Monitoring of Contract a) An officer or a committee of officers named Contract Monitoring Committee (CMC) may be nominated by procuring entity to monitor the progress of the contract during its delivery period. b) During the delivery period the CMC shall keep a watch on the progress of the contract and shall ensure service delivery is in proportion to the total delivery period given, if it is a severable contract, in which the delivery of service is to be obtained continuously or is batched. If the entire service is to be delivered in the form of completed work or entire contract like fabrication work, the process of completion of work may be watched and inspections of the selected bidder’s premises where the work is being completed may be inspected. RISL Rate Contract for Security Audit of Website(s) / Web Application(s) / portal(s) c) If delay in delivery of service is observed a performance notice would be given to the selected bidder to speed up the delivery. d) Any change in the constitution of the firm, etc. shall be notified forth with by the contractor in writing to the procuring entity and such change shall not relieve any former member of the firm, etc., from any liability under the contract. e) No new partner/ partners shall be accepted in the firm by the selected bidder in respect of the contract unless he/ they agree to abide by all its terms, conditions and deposits with the procuring entity through a written agreement to this effect. The bidder’s receipt for acknowledgement or that of any partners subsequently accepted as above shall bind all of them and will be sufficient discharge for any of the purpose of the contract. f) The selected bidder shall not assign or sub-let his contract or any substantial part thereof to any other agency without the permission of procuring entity. During the deployment period, the CMC shall keep a watch on the progress of the contract and shall ensure that quantity of resource deployment is in proportion to the total deployment period given if it is a severable contract, in which the deployment of resources and service is to be obtained continuously or is batched. If the entire quantity of goods and service is to be delivered in the form of completed work or entire contract like fabrication work, the process of completion of work may be watched, and inspections of the selected bidder’s premises where the work is being completed may be inspected. c. If delay in deployment of resources and service is observed, a performance notice would be given to the selected bidder to speed up the deployment. d. Any change in the constitution of the firm, etc. shall be notified forthwith by the contractor in writing to the procuring entity and such change shall not relieve any former member of the firm, etc., from any liability under the contract. e. Monitoring of Contract. SAC reserves the right to review and verify the progress of work at any stage / any time and adherence by the contractor to the safety & quality standard and procedures specified.

Monitoring of Contract. Catapult Learning agrees to be subjected to monitoring of this contract which includes reviewing records of services rendered, items purchased, payroll records, accounting records, fraud prevention measures and internal controls by the NJDOE and/or a vendor hired by the NJDOE. Notwithstanding the foregoing, in the event of a conflict between the State’s Standard Terms & Conditions, attached hereto and in effect on the date of this Agreement (Schedule B) and the State’s Waivered Terms and Conditions (Schedule C).

Monitoring of Contract. 20.1 The Bidder (designated contracts manager) and the authorising officers of the Trusts will be responsible for monitoring the quality and effectiveness of the service. Bidders should submit with their tender a statement on how these standards will be achieved and monitored in the form of Key Performance Indicators (KPIs). This performance regime will be agreed between the successful Bidder and the Trusts. The aim will be to develop and agree KPIs which are commercially sensitive and pragmatic. 20.2 The Trusts, in accordance with their Duty of Care principles, will develop the above formal monitoring system with the Bidder, to commence at the start of the contract and be based on a continuous assessment process throughout the life of the contract. 20.3 The Trusts reserve the right to inspect, with or without prior notice, all records relating to the performance of the contract. 20.4 The Trusts reserves the right to visit any specified holding/waste disposal site during the contract period. 20.5 The named Contracts Manager will be the primary point of contact in relation to the contract for routine day-to- day issues.

Monitoring of Contract. The contract manager/Division Head, PAID/SNSICG from SAC and SAC management will be reviewing the progress of the work at various stages during the contract duration. The contractor is required to provide all necessary information on this matter, as and when solicited by SAC.

Per Attachment C, Section 15, if the Contractor chooses to subcontract work under this agreement, the Contractor must first fill out and submit the Request for Approval to Subcontract Form (Appendix I – Required Forms) in order to seek approval from the State prior to signing an agreement with a third party. Upon receipt of the Request for Approval to Subcontract Form, the State shall review and respond within five (5) business days.
