The "Monthly Base Capacity" clause defines the minimum level of service, production, or resource allocation that must be provided or maintained each month under an agreement. Typically, this clause specifies a set quantity or threshold—such as units produced, hours worked, or bandwidth supplied—that the provider is obligated to meet on a monthly basis. For example, a supplier might be required to deliver at least 1,000 units per month, or a service provider may need to guarantee a certain level of system uptime. The core function of this clause is to ensure predictability and reliability in performance, helping both parties plan operations and manage expectations by setting clear monthly benchmarks.
MONTHLY BASE CAPACITY. The Shipper subscribing a “band” or “spot” service with the LNG terminal Operator will be allocated firm monthly capacity equal to one thirtieth (1/30th) of regasification capacity subscribed with the LNG terminal Operator. Such capacity is allocated for periods of thirty (30) days, starting from the unloading end date initially agreed by the LNG terminal Operator and the Shipper. The capacity allocation period shall not be affected by any delay in unloading; however, the quantities delivered at the Transport LNG Terminal Interface Point are scheduled taking into account such delay and in compliance with Appendix D2.1 of Section D2. In case of cancellation of the unloading, the capacity allocated at the Transport LNG Terminal Interface Point remains due.
MONTHLY BASE CAPACITY. The Shipper subscribing a “uniform” or “spot” service with the LNG terminal Operator will be allocated firm monthly capacity equal to one thirtieth (1/30th) of the regasification capacity subscribed with the LNG terminal Operator. Such capacity is allocated for periods of thirty (30) days, starting from the unloading end date initially agreed by the LNG terminal Operator and the Shipper. If unloading is cancelled, the South-To-North Link capacity allocated within the « FOS + ▇▇▇ ▇▇▇▇ » Service remains due. « FOS + ▇▇▇ ▇▇▇▇ » Service is subscribed with a minimum prior notice of three (3) Working Days.

  • INDEPENDENT CAPACITY The employees or agents of each party who are engaged in the performance of this Agreement shall continue to be employees or agents of that party and shall not be considered for any purpose to be employees or agents of the other party.
