Common use of Monthly Schedule Update Clause in Contracts

Monthly Schedule Update. 6.5.3.1. At monthly intervals, the Contractor shall update the schedule to reflect actual progress and submit the schedule update to the Construction Manager for review and acceptance in accordance with the Specification. The Monthly Schedule Update shall record progress for the period from the last Monthly Schedule Update through the current cutoff date set forth by the Construction Manager. The Monthly Schedule Update shall also forecast the remainder of the Work. The Monthly Schedule Update must not deviate significantly from the Baseline Schedule and shall not be used to delete or add activities, make title changes, and to make duration or logic changes. The Construction Manager may refuse to recommend the whole or part of any payment if, in the Construction Manager’s opinion, the Contractor’s failure, refusal or neglect to provide the required schedule information precludes a proper evaluation of whether or not the Contractor is prosecuting the work with the diligence that will ensure completion of the work within the Contract Time.
