Moratoria or Interim Control Ordinances Clause Samples

A Moratoria or Interim Control Ordinances clause allows a governing body to temporarily halt certain types of development or land use activities while it studies or addresses specific planning issues. In practice, this clause can be used to pause the issuance of building permits or approvals for new projects in a designated area, often in response to concerns about infrastructure, environmental impacts, or community character. Its core function is to provide local authorities with time to evaluate and implement appropriate regulations, thereby preventing undesirable or unplanned development during periods of review or transition.
Moratoria or Interim Control Ordinances. In the event an ordinance, resolution, policy, or other measure is enacted, whether by action of the City, by initiative, or otherwise, which relates directly or indirectly to the Project or to the rate, amount, timing, sequencing, or phasing of the development or construction of the Project on all or any part of the Property, City agrees that such ordinance, resolution or other measure shall not apply to the Property or this Agreement, unless such changes: (1) are found by the City to be necessary to the public health and safety of the residents of the City, (2) are generally applicable on a Citywide basis except in the event of natural disasters as found by the Mayor or the City Council, such as floods, earthquakes and similar disasters and (3) are necessary to comply with state or federal laws and regulations (whether enacted previous or subsequent to the Effective Date of this Agreement) as provided in Section 3.2.3.3.

Moratoria or Interim Control Ordinances. No ordinance, resolution, policy, or other measure enacted after the Effective Date and that relates directly or indirectly to the Project or to the rate, amount, timing, sequencing, or phasing of the development or construction of the Project shall apply to the Project Site or this Agreement, unless it: (i) is reasonably found by the City to be necessary to the public health and safety of the residents of the City, and (ii) is generally applicable on a Citywide basis (except in the event of natural disasters such as floods, earthquakes and similar disasters).
Moratoria or Interim Control Ordinances. No ordinance, resolution, policy, or other measure enacted or approved after the Effective Date that relates directly or indirectly to the Projects or to fees associated with or the timing, sequencing, or phasing of the development or construction of the Projects shall apply to the Properties or this Agreement, unless it is: (i) necessary to the public health and safety of the residents of the City, and

  • Section 504 of the Rehabilitation Act of 1973 Contractor shall comply with Section 504 of the Rehabilitation Act of 1973, as amended, which provides that no otherwise qualified individual with a disability shall, solely by reason of a disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination in the performance of any services this Agreement. This Section applies only to contractors who are providing services to members of the public under this Agreement.

  • Ordinances and Statutes Lessee shall comply with all statutes, ordinances and requirements of all municipal, state and federal authorities now in force, or which may hereafter be in force, pertaining to the premises, occasioned by or affecting the use thereof by Lessee.

  • Compliance with Federal Law, Regulations, and Executive Orders This is an acknowledgement that FEMA financial assistance will be used to fund all or a portion of the contract. The contractor will comply with all applicable Federal law, regulations, executive orders, FEMA policies, procedures, and directives.

  • Prohibition on Contracts with Companies Boycotting Israel To the extent that Texas Government Code, Chapter 2271 applies to this Agreement, PROVIDER certifies that (a) it does not currently boycott Israel; and (b) it will not boycott Israel during the term of this Agreement. PROVIDER acknowledges this Agreement may be terminated and payment withheld if this certification is inaccurate.
