Common use of Mutual Obligations Clause in Contracts

Mutual Obligations. The parties agree that they will neither directly nor indirectly receive remuneration in exchange for any PHI of a Patient, unless a valid authorization, pursuant to 45 CFR 164.508, is executed by that Patient. Notwithstanding the foregoing, the parties agree that they may receive remuneration in exchange for PHI of a patient in accordance with 42 USC § 17935(d)(2) and 45 CFR 164.502(a)(5)(ii)(B)(2).
