Common use of NAME OF THE PORTFOLIO Clause in Contracts

NAME OF THE PORTFOLIO. The parties agree that the Portfolio may use the name "Cullen" and any logos or service marks that the Sub-Adviser may furnish to the Portfolio (collectively, the "Identifying Marks") only so long as (i) this Agreement remains in effect and (ii) the Sub-Adviser has the right to use such Identifying Marks. Any use of the Identifying Marks pursuant to this Section 15 shall be royalty free. Upon termination of this Agreement, the Portfolio promptly shall discontinue the use of the Identifying Marks. Upon notification from the Sub-Adviser to the Portfolio that the Sub-Adviser ceases to have the right to use an Identifying Mark, the Portfolio promptly ▇▇▇▇l discontinue the use of such Identifying Mark. The Portfolio acknowled▇▇▇ that (i) it has no proprietary or exclusive rights in the Identifying marks and (ii) the Sub-Adviser reserves to itself the right to grant the nonexclusive right to use any Identifying Marks to other persons (including other investment companies), subject to the Sub-Adviser's right with respect to such Identifying Marks.
