Common use of Nature of Representations Clause in Contracts

Nature of Representations. 10.01 All statements contained in any written certificate, schedule, exhibit or other written instrument delivered by Fortium, or White River or Ecoark pursuant hereto, or otherwise adopted by any of Fortium, White River or Fortium by their respective written approval, or in connection with the transactions contemplated hereby, shall be deemed representations and warranties by Fortium, or White River or Ecoark, as the case may be. All representations, warranties and agreements made by any party pursuant to this Agreement shall survive for the period of the applicable statute of limitations.
