Common use of Negotiated Proposal and Acceptance Basis Clause in Contracts

Negotiated Proposal and Acceptance Basis. Prior to performing any Extra Work, the CONTRACTOR shall prepare and submit a written proposal including a description of the work, a list of materials, and a schedule for completion. No work shall commence without written approval of the CONTRACTOR’s proposal by the Director of Public Works or his/her authorized representative. When a condition exists which the Director of Public Works or his/her authorized representative deems an emergency, the Director of Public Works may verbally authorize the work to be performed upon receiving a verbal estimate from the CONTRACTOR. However, within twenty-four (24) hours after receiving a verbal authorization, the CONTRACTOR shall submit a written estimate, consistent with the verbal authorization, to the Director of Public Works or his/her authorized representative for approval. All Extra Work shall commence on the specified date established and CONTRACTOR shall proceed diligently to complete said work within the time allotted.
