Common use of Net Maintenance Clause in Contracts

Net Maintenance. Under a Net Maintenance Lease, Customer shall, at Customer’s sole expense, maintain the Equipment in good operating order and in the same condition and appearance as noted on the Outbound Inspection (including, without limitation, preventive maintenance, emergency service and damage repairs and replacements), Normal Wear excepted. For clarity, Customer shall be solely responsible for all maintenance, and when necessary, replacement of all parts, accessories and tires. Customer shall cause all such repairs and maintenance to be completed in accordance with ▇▇▇▇▇▇▇▇’▇ repair and maintenance standards and with all requirements necessary to enforce ▇▇▇▇▇▇▇▇’▇ warranty rights related to the Equipment. In addition, Customer shall timely conduct all inspections of the Equipment required under Applicable Law (including, without limitation, all inspections required by the Department of Transportation or the California Commercial Motor Vehicle Safety Act of 1988, as amended (commonly referred to as the Basic Inspection of Terminals)) (collectively, “Legally-Required Inspections”).
