Network Protection. In the event of an attack on the network by one or more third parties, the franchisor guarantees the franchisee that it will take the initiative and direction of any action for infringement, unfair competition or opportunistic parasitism. The franchisee also undertakes to bring to the attention of the franchisor any attack not known to it. The franchisor alone bears the costs relating to legal action except when the franchisee joins the franchisor's action. Where applicable, the legal costs are divided equally between the franchisor, the franchisee and the other members of the network joining the legal action.
