Common use of No Assignment by Contractor Clause in Contracts

No Assignment by Contractor. The Contractor shall not assign this Agreement or any interest in any funds that may be due or become due hereunder or enter into any contract with any person, firm or corporation for the performance of the Contractor's obligations hereunder or any part thereof, except as specifically provided herein, without the prior approval in writing of the General Contractor. If the Contractor, with the consent of the General Contractor, shall enter into a subcontract with any Subcontractor for the performance of any part of this Agreement, the Contractor shall be as fully responsible to the General Contractor for the acts and omissions of such Subcontractor and of persons employed by such subcontractor as the Contractor would be for its own acts and omissions and those of persons directly employed by it. Nothing in this Section 16.1 shall be read to limit the General Contractor's rights to assign its interest in this Agreement or the Project under Section 16.2.
