Common use of No capacity Clause in Contracts

No capacity. Without limiting clause 5.2(b) or clause 5.6, Viterra may decline to receive Grain for storage on behalf of the Client at a Viterra Facility if: (a) the export storage capacity in that Viterra Facility allocated to a particular Binned Grade at that Viterra Facility is already full; and (b) Viterra is unable to make additional space available for that Binned Grade by either movement of the Grain to another Viterra Facility or by Outturn of the Grain. Nothing in this clause 5.7 requires Viterra to move any Other Client’s Grain which is in an export position at that time.
