Common use of No Consumer Accounts Clause in Contracts

No Consumer Accounts. Customer acknowledges, represents, warrants, and agrees that all accounts that will be accessed under this Agreement are not accounts established primarily for personal, family or household purposes. Accordingly, the provisions of the Electronic Fund Transfer Act, as amended (15 U.S.C. 1693 et seq.), Federal Reserve Regulation E, as amended (12 C.F.R. 205), and any other laws or regulations intended for the protection of or governance of transactions involving consumers or consumer accounts do not apply to any transactions involving Accounts subject to this Agreement, except to the extent such provisions are expressly set forth herein. Bank may terminate this Agreement immediately and without notice to Customer if Bank becomes aware that Customer is using the System, the Services or the Account for personal, family or household purposes or if the System or Services is being utilized to access personal, family or household purposes accounts, unless expressly permitted by Bank.
