No Defect Found. If Flextronics is unable to find any defect, or reproduct a malfunction, (a “Defect”) in a component or material returned by INFOCUS under warranty after using reasonable efforts to do so, the parties shall cooperate in good faith to find the cause of such Defects and take remedial measures. INFOCUS will use reasonable commercial efforts to ensure that only “known defective” Products are returned to Flextronics as part of a warranty claim. Parties to agree to a reasonable quantity of “No Fault Detected” returns that are inadvertently returned to Flextronics as a percentage of all returns for a given model. INFOCUS agrees to reimburse freight costs associated with NDF returns for any quantity exceeding the agreed to percentage.
