Common use of No Exclusion Clause in Contracts

No Exclusion. Nothing in this Agreement shall exclude or limit, or purport to exclude or limit, a Party’s liability in the case of: (a) breach of clause 8; (b) fraud or fraudulent misrepresentation; (c) death or personal injury resulting from its negligence; or (d) any other matter in respect of which it would be unlawful to exclude or restrict liability.

Nothing in this Agreement shall exclude or limit, or purport to exclude or limit, a Party’s liability in the case of: (a) breach of clause 8wilful misconduct, fraud or fraudulent misrepresentation; (b) fraud or fraudulent misrepresentationany breach of Article 14 (Confidentiality); (c) death or personal injury resulting from its negligence; (d) [***]; or (de) any other matter in respect of which it would be unlawful to exclude or restrict liability.

No Exclusion. Nothing in this Agreement shall operate to limit or exclude or limit, or purport to exclude or limit, a either Party’s liability in the case of: 's liability: (a) breach for death or personal injury caused by its negligence or that of clause 8; (b) its employees, agents or subcontractors or for fraud or fraudulent misrepresentation; ; (b) for breach of obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; (c) death or personal injury resulting from its negligencefor infringement of the other Party's Intellectual Property Rights; or (d) any other matter in respect for breach of its confidentiality obligations under Clause 8; or (e) which it would may not be unlawful to exclude limited or restrict liabilityexcluded by applicable law.
