Common use of NO KICK-BACK CERTIFICATION Clause in Contracts

NO KICK-BACK CERTIFICATION. CONTRACTOR warrants that no person has been employed or retained to solicit or secure the Agreement upon an agreement or understanding for a commission, percentage, brokerage or contingent fee; and that no member of the City Council or any employee of the City has an interest, financially or otherwise, in the CONTRACTOR. For breach or violation of this warranty, the City shall have the right to annul the Agreement without liability, or at its discretion to deduct from the compensation to be paid CONTRACTOR hereunder, the full amount of such commission, percentage, brokerage or contingent fee.
