Common use of No Minimums Clause in Contracts

No Minimums. Both Parties understand and acknowledge that the quantity and variety of the Product ordered by Buyer will be derived from marketing projections that may not necessarily depict actual sales volume since the Products may represent a new entry by Buyer into the snack food market; therefore, the total quantity of Product to be purchased hereunder is subject to wide fluctuation. Notwithstanding anything contained herein to the contrary, Buyer shall not be required to purchase any minimum quantity of any Product from Manufacturer. This Agreement shall not be deemed to constitute a requirements contract or to impose any obligation to purchase any portion of output by Buyer.
