Common use of No Responsibility for Administration or Fees Clause in Contracts

No Responsibility for Administration or Fees. ‌ (1) Without limiting the Settling Defendants’ obligations under the Settlement Agreement to pay the Settlement Payment and provide the cooperation required herein, the Settling Defendants shall not have any responsibility, financial obligations or liability whatsoever with respect to the investment, distribution or administration of the Settlement Payment including, but not limited to, Administration Expenses, Funder Entitlements and Class Counsel Fees and Disbursements, except in the event of the termination of the Settlement Agreement as provided in section 15. (2) Without limiting the Settling Defendants’ obligations under the Settlement Agreement to pay the Settlement Payment and provide the cooperation required herein, the Settling Defendants shall have no responsibility, financial obligations or liability whatsoever with respect to the implementation, supervision or administration of the Settlement Agreement, and/or Distribution Protocol or the claims process required by the Distribution Protocol.
