No Responsibility For Company Representations. The Common Stock Warrant Agent shall not be responsible for any of the recitals or representations contained herein (except as to such statements or recitals as describe the Common Stock Warrant Agent or action taken or to be taken by it or such statements or recitals known by the Common Stock Warrant Agent to be false or misleading) or in any Common Stock Warrant Certificate (except as to the Common Stock Warrant Agent's countersignature on such Common Stock Warrant Certificate), all of which recitals and representations are made solely by the Company.
