Common use of NO WAIVER OF PERFORMANCE Clause in Contracts

NO WAIVER OF PERFORMANCE. The failure of the Contractor to insist upon the performance of any of the terms, covenants or conditions of the Subcontract, or to exercise any of its rights, shall not be construed as a waiver or relinquishment of the term, covenant, condition or right with respect to further performance of Subcontractor.
