No Waiver; Severability. The failure of Buyer to insist upon the performance of any provision of this AGREEMENT, or to exercise any right or privilege granted to Buyer under this AGREEMENT, shall not be construed as waiving such provision or any other provision of this AGREEMENT, and the same shall continue in full force and effect. If any provision of this AGREEMENT is adjudged by a court to be invalid, void, or unenforceable, the Parties agree that the remaining provisions of this AGREEMENT shall not be affected thereby, that the provision in question may be replaced by the lawful provision that most nearly embodies the original intention of the Parties, and that this AGREEMENT shall in any event otherwise remain valid and enforceable.
