Common use of Nomination Clause in Contracts

Nomination. The Allottees admit and accept that before the execution and registration of conveyance deed of the Said Apartment And Appurtenances, the Allottees will be entitled to nominate, assign and/or transfer the Allottees‟ right, title, interest and obligations under this Agreement as per clause 20 subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. The Allottees shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2. The Allottees shall obtain prior written permission of the Promoter and the Allottees and the nominee shall be bound to enter into a tripartite agreement with the Owners and the Promoter. 12.3. The Allottees shall pay an additional legal fee of Rs.10,000/- (Rupees ten thousand) to the Promoter‟s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nomination. 12.4. Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees shall be entitled to nominate, assign and/or transfer the Allottees‟ right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

Nomination. (a) The Allottees Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2. (b) The Allottees Allottee shall obtain prior written permission of the Promoter and the Allottees Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owners and the Promoter. 12.3. (c) The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- (Rupees ten thousand) to the Promoter‟s Promoter’s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

(d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottees’ right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

Nomination. The Allottees allottee shall pay an additional legal fee of Rs.10,000/- Rs. 10,000.00 (Rupees ten thousandTen Thousand) only to the Promoter‟s promoter’s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationnomination agreement. 12.4. d. Subject to the approval and acceptance of the Promoter promoter and subject to the above conditions, the Allottees . The allottee shall be entitled to nominate, assign and/or and transfer the Allottees‟ allottee right, title, interest and obligations obligation under this Agreement agreement to parent, spouse and children without payment of the aforesaid transfer chargecharges. 1. The Allottees admit Allottee admits and accept accepts that before the execution and registration of conveyance deed of the Said Apartment Flat And Appurtenances, the Allottees Allottee will be entitled to nominate, assign and/or transfer the Allottees‟ Allottee‟s right, title, interest and obligations under this Agreement on payment of 3% (three percent) of the market price prevailing at that time (to be determined by the Promoter) as per clause 20 nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. (a) The Allottees Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2. (b) The Allottees Allottee shall obtain prior written permission of the Promoter and the Allottees Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owners and the Promoter. 12.3. (c) The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- (Rupees ten thousand) to the Promoter‟s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee‟s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. Nomination. The Allottees admit Allottee admits and accept accepts that before the execution and registration of conveyance deed Deed Of Transfer/Sub Lease of the Said Apartment And Appurtenances, the Allottees Allottee will be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as per clause 20 nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. (a) The Allottees Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2. (b) The Allottees Allottee shall obtain prior written permission of the Promoter and the Allottees Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owners Transferor and the Promoter. 12.3. (c) The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- Rs. /- (Rupees ten thousand) to the Promoter‟s Promoter’s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. (b) The Allottees Allottee shall obtain prior written permission of the Promoter and the Allottees Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owners and the Promoter. 12.3. (c) The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- (Rupees ten thousand) to the Promoter‟s Promoter’s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. (e) The Allotte shall not nominate his/her/their right to the Said Apartment before completion of 18 (eighteen) months from the date of execution of the Agreement for Sale. SCHEDULE ‘G’ 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

Nomination. The Allottees admit Allottee/s admit/s and accept accept/s that before the execution and registration of conveyance deed of the Said Apartment Flat And Appurtenances, the Allottees Allottee/s will be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoters) as per clause 20 nomination charge to the Promoters, if the cancelation is done beyond 15 (fifteen) days from the date of execution of this Agreement, subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. (a) The Allottees Allottee/s shall make payment of all dues of the Promoter Promoters in terms of this Agreement, up to the time of nomination. 12.2. (b) The Allottees Allottee/s shall obtain prior written permission of the Promoter Promoters and the Allottees Allottee/s and the nominee shall be bound to enter into a tripartite agreement with the Owners and the PromoterDeveloper. 12.3. (c) The Allottees Allottee/s shall pay an additional legal fee of Rs.10,000/- (Rupees ten thousand) to the Promoter‟s Promoters’ legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter Promoters and subject to the above conditions, the Allottees Allottee/s shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. 8th Schedule (Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.Expenses)

The Allottees admit Allottee admits and accept accepts that before the execution and registration of conveyance deed Deed Of Transfer/Sub Lease of the Said Apartment And Appurtenances, the Allottees Allottee will be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Transferor) as per clause 20 nomination charge to the Transferor subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. (a) The Allottees Allottee shall make payment of all dues of the Promoter Transferor in terms of this Agreement, up to the time of nomination. 12.2. (b) The Allottees Allottee shall obtain prior written permission of the Promoter Transferor and the Allottees Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owners Transferor and the PromoterTransferor. 12.3. (c) The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- (Rupees ten thousand) to the Promoter‟s Transferor/Promoter’s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Transferor/Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee‟s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. (c) The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- (Rupees ten thousand) to the Promoter‟s Promoter’s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter and Promoterand subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

Nomination. The Allottees admit Allottee admits and accept accepts that before the execution and registration of conveyance deed of the Said Apartment Flat And Appurtenances, the Allottees Allottee will be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement on payment of 3% (three percent) of the market price prevailing at that time (to be determined by the Vendor) as per clause 20 nomination charge to the Vendor subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. (a) The Allottees Allottee shall make payment of all dues of the Promoter Vendor in terms of this Agreement, up to the time of nomination. 12.2. (b) The Allottees Allottee shall obtain prior written permission of the Promoter Vendor and the Allottees Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owners and the PromoterVendor. 12.3. (c) The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- (Rupees ten thousand) to the Promoter‟s Vendor’s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter Vendor and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.. SCHEDULE ‘H’ (Common Expenses) 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

The Allottees admit Allottee admits and accept accepts that before the execution and registration of conveyance deed of the Said Apartment And AppurtenancesApartment, the Allottees Allottee will be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as per clause 20 nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. i. The Allottees Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2ii. The Allottees Allottee shall obtain prior written permission of the Promoter and the Allottees Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owners and the Promoter. 12.3iii. The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- Rs. 10,000/- (Rupees ten thousand) only to the Promoter‟s Promoter’s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4iv. (a) The Allottees Allottee/Transferee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2. (b) The Allottees Allottee/Transferee shall obtain prior written permission of the Promoter and the Allottees Allottee/Transferee and the nominee shall be bound to enter into a tripartite agreement with the Owners Transferor and the Promoter. 12.3. (c) The Allottees Allottee/Transferee shall pay an additional legal fee of Rs.10,000/- (Rupees ten thousand) to the Promoter‟s Promoter’s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee/Transferee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s/Transferee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

Nomination. The Allottees admit Allottee admits and accept accepts that before the execution and registration of conveyance deed of the Said Apartment And AppurtenancesApartment, the Allottees Allottee will be entitled to nominate, assign and/or transfer the Allottees‟ Allottee‟s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as per clause 20 nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. : • The Allottees Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2. • The Allottees Allottee shall obtain prior written permission of the Promoter and the Allottees Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owners Owner and the Promoter. 12.3. • The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- Rs. 10,000/- (Rupees ten thousandthousand only) to the Promoter‟s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nomination. 12.4Agreement. • Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee‟s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

The Allottees admit admits and accept accepts that before the execution and registration of conveyance deed of the Said Apartment And Appurtenances, the Allottees will be entitled to nominate, assign and/or transfer the Allottees‟ Allottees’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Owners/Promoters) as per clause 20 nomination charge to the Owners/Promoters subject to the covenant by the For Fortune Park Housing Projects Pvt. Ltd nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. (a) The Allottees shall make payment of all dues of the Promoter Owners/Promoters in terms of this Agreement, up to the time of nomination. 12.2. (b) The Allottees shall obtain prior written permission of the Promoter Owners/Promoters and the Allottees and the nominee shall be bound to enter into a tripartite agreement with the Owners and the PromoterOwners/Promoters. 12.3. (c) The Allottees shall pay an additional legal fee of Rs.10,000/- Rs.20,000/- (Rupees ten Twenty thousand) to the Promoter‟s Owners/Promoters’ legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter Owners/Promoters and subject to the above conditions, the Allottees shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottees’ s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement to parentobligationsunderthis Agreementtoparent, spouse and children without payment of the aforesaid spouseandchildrenwithoutpaymentoftheaforesaid transfer charge. 1. 6th Schedule (Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.Expenses/Maintenance Charges)

The Allottees admit Allottee admits and accept accepts that before the execution and registration of conveyance deed of the Said Apartment Flat And Appurtenances, the Allottees Allottee will be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement on payment of 3% (three percent) of the market price prevailing at that time (to be determined by the Promoter) as per clause 20 nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. (a) The Allottees Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2. (b) The Allottees Allottee shall obtain prior written permission of the Promoter and the Allottees Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owners and the Promoter. 12.3. (c) The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- (Rupees ten thousand) to the Promoter‟s Promoter’s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. The Allottees admit and accept that before the execution and registration of conveyance deed of the Said Apartment Bungalow And Appurtenances, the Allottees will be entitled to nominate, assign and/or transfer the Allottees‟ Allottees’ right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as per clause 20 nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. (a) The Allottees shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2. The Transferees/Allottees admit and accept that before the execution and registration of conveyance deed Deed Of Transfer/Sub Lease of the Said Apartment Unit And Appurtenances, the Transferees/Allottees will be entitled to nominate, assign and/or transfer the Allottees‟ Transferees/Allottees’ right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoters) as per clause 20 nomination charge to the Promoters subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. (a) The Transferees/Allottees shall make payment of all dues of the Promoter Promoters in terms of this Agreement, up to the time of nomination. 12.2. (b) The Transferees/Allottees shall obtain prior written permission of the Promoter Promoters and the Transferees/Allottees and the nominee shall be bound to enter into a tripartite agreement with the Owners Transferor and the PromoterPromoters. 12.3. (c) The Transferees/Allottees shall pay an additional legal fee of Rs.10,000/- Rs. 10,000/- (Rupees ten thousand) to the Promoter‟s Promoters’ legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter Promoters and subject to the above conditions, the Transferees/Allottees shall be entitled to nominate, assign and/or transfer the Allottees‟ Transferees/Allottees’ right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. Nomination. The Allottees admit Allottee admits and accept accepts that before the execution and registration of conveyance deed of Sub Lease/Transfer/Assignment of the Said Apartment Unit And AppurtenancesAppurtenances but not before 12 (twelve) months from the date of execution of this Agreement, the Allottees Allottee will be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement on payment of Rs.100/- (Rupees one hundred) per square feet as per clause 20 nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned following conditions: 12.1. 9.1 The Allottees Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2. 9.2 The Allottees Allottee shall obtain prior written permission of the Promoter and the Allottees Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owners and the Promoter. 12.3. 9.3 The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- (Rupees ten thousand) to the Promoter‟s legal advisors Legal Advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. 9.4 Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer nomination charge. 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

Nomination. The Allottees admit Allottee admits and accept accepts that before the execution and registration of conveyance deed Deed Of Transfer/Sub Lease of the Said Apartment And Appurtenances, the Allottees Allottee will be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as per clause 20 nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1. (a) The Allottees Allottee shall make payment of all dues of the Promoter in terms of this Agreement, up to the time of nomination. 12.2. (b) The Allottees Allottee shall obtain prior written permission of the Promoter and the Allottees Allottee and the nominee shall be bound to enter into a tripartite agreement with the Owners Transferor and the Promoter. 12.3. (c) The Allottees Allottee shall pay an additional legal fee of Rs.10,000/- Rs. 10,000/- (Rupees ten thousand) to the Promoter‟s Promoter’s legal advisors towards the tripartite Nomination Agreement and shall further pay to the Promoter a sum equivalent to 3 (three) months of Common Area Maintenance (CAM) charges in advance prior to the nominationAgreement. 12.4. (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge. 1. (d) Subject to the approval and acceptance of the Promoter and subject to the above conditions, the Allottees Allottee shall be entitled to nominate, assign and/or transfer the Allottees‟ Allottee‟s right, title, interest and obligations under this Agreement to parent, spouse and children without payment of the aforesaid transfer charge.. SCHEDULE „H‟ (Common Expenses) 1. Common Utilities: All charges, costs and deposits for supply, operation and maintenance of common utilities.

Nomination. The Allottees admit Allottee admits and accept accepts that before the execution and registration of conveyance deed of the Said Apartment Unit And Appurtenances, the Allottees Allottee will be entitled to nominate, assign and/or transfer the Allottees‟ Allottee’s right, title, interest and obligations under this Agreement on payment of 2% (two percent) of the market price prevailing at that time (to be determined by the Promoter) as per clause 20 nomination charge to the Promoter subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the below mentioned conditions: 12.1.
