Common use of NOMINEE Clause in Contracts

NOMINEE. 23.1 The Purchaser shall be entitled, by notice in writing to the Seller, to nominate a nominee in his place as Purchaser, upon the following terms and conditions: 23.1.1 the aforesaid notice shall be handed to the Seller by not later than 24h00 on the same day as the acceptance date by the Seller; 23.1.2 the notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇; 23.1.3 the notice shall be accompanied by the nominee’s written acknowledgement: 23.1.4 that it is fully aware of all the terms and conditions of this agreement as if fully set out in such written acknowledgement; and 23.1.5 that it is bound by the provisions of this agreement as the Purchaser; 23.2 Should the Purchaser nominate a nominee in terms of this clause, then: 23.2.1 all reference to the Purchaser in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 the Purchaser by his signature hereto, ▇▇▇▇▇▇ interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as Purchaser, to and in favour of the Seller, for all the Purchaser’s obligations under this agreement, including damages.

NOMINEE. 23.1 21.1 The Purchaser shall be entitled, by notice in writing to the Seller, to nominate a nominee in his place as Purchaser, upon the following terms and conditions: 23.1.1 21.1.1 the aforesaid notice shall be handed to the Seller by not later than 24h00 on the same day as the acceptance date by the Seller; 23.1.2 21.1.2 the notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇; 23.1.3 21.1.3 the notice shall be accompanied by the nominee’s written acknowledgement: 23.1.4 21.1.4 that it is fully aware of all the terms and conditions of this agreement as if fully set out in such written acknowledgement; and 23.1.5 21.1.5 that it is bound by the provisions of this agreement as the Purchaser; 23.2 21.2 Should the Purchaser nominate a nominee in terms of this clause, then: 23.2.1 21.2.1 all reference to the Purchaser in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 21.2.2 the Purchaser by his signature hereto, ▇▇▇▇▇▇ interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as Purchaser, to and in favour of the Seller, for all the Purchaser’s obligations under this agreement, including damages.

NOMINEE. 23.1 The Purchaser PURCHASER shall be entitled, by notice in writing to the SellerSELLER, to nominate a nominee in his place as PurchaserPURCHASER, upon the following terms and conditions: 23.1.1 the 9.1 The aforesaid notice shall be handed to the Seller SELLER by not no later than 24h00 close of business on the same day as the acceptance date by the SellerDATE OF ACCEPTANCE; 23.1.2 9.1.1 the notice shall set out the same name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇;PURCHASER: 23.1.3 9.1.2 the notice shall be accompanied by the nominee’s written acknowledgement: 23.1.4 that 9.1.2.1 That it is fully aware of all the terms and conditions of this agreement as if fully set out in such written acknowledgement; and 23.1.5 that 9.1.2.2 That it is bound by the provisions of this agreement as the PurchaserPURCHASER; 23.2 9.2 Should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 9.2.1 all reference references to the Purchaser PURCHASER in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 9.2.2 the Purchaser PURCHASER by his signature hereto, ▇▇▇▇▇▇ hereby interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour of the SellerSELLER, for all the Purchaser’s PURCHASER’S obligations under this agreement, including damages, and renounces the benefits of division and excussion.

That it is bound by the provisions of this agreement as the PurchaserPURCHASER; 23.2 9.3. Should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 9.3.1. all reference references to the Purchaser PURCHASER in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 9.3.2. the Purchaser PURCHASER by his signature hereto, ▇▇▇▇▇▇ interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour favor of the SellerSELLER, for all the Purchaser’s PURCHASER’S obligations under this agreement, including damages, and renounces the benefits of division and excussion.

NOMINEE. 23.1 The Purchaser PURCHASER shall be entitled, by notice in writing to the SellerSELLER, to nominate a nominee in his place as PurchaserPURCHASER, upon the following terms and conditions: 23.1.1 19.1. the aforesaid notice shall be handed to the Seller SELLER by not later than 24h00 on the same day as the acceptance date by the SellerSELLER; 23.1.2 19.2. the notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇PURCHASER; 23.1.3 19.3. the notice shall be accompanied by the nominee’s written acknowledgement: 23.1.4 19.3.1. that it is fully aware of all the terms and conditions of this agreement Deed of Sale as if fully set out in such written acknowledgement; and 23.1.5 19.3.2. that it is bound by the provisions of this agreement Deed of Sale as the PurchaserPURCHASER; 23.2 Should 19.4. should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 19.4.1. all reference to the Purchaser PURCHASER in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 19.4.2. the Purchaser PURCHASER by his signature hereto, ▇▇▇▇▇▇ hereby interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour of the SellerSELLER and/or the AGENT, for all the Purchaser’s PURCHASER'S obligations under this agreement, including damages, and renounces the benefits of division and excussion.

NOMINEE. 23.1 The Purchaser PURCHASER shall be entitled, by notice in writing to the SellerSELLER, to nominate a nominee in his place as PurchaserPURCHASER, upon the following terms and conditions: 23.1.1 20.1 the aforesaid notice shall be handed to the Seller SELLER by not later than 24h00 on the same day as the acceptance date by the SellerSELLER; 23.1.2 20.2 the notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇PURCHASER; 23.1.3 20.3 the notice shall be accompanied by the nominee’s written acknowledgement: 23.1.4 20.3.1 that it is fully aware of all the terms and conditions of this agreement Deed of Sale as if fully set out in such written acknowledgement; and 23.1.5 20.3.2 that it is bound by the provisions of this agreement Deed of Sale as the PurchaserPURCHASER; 23.2 Should 20.4 should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 20.4.1 all reference to the Purchaser PURCHASER in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 20.4.2 the Purchaser PURCHASER by his signature hereto, ▇▇▇▇▇▇ hereby interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour of the SellerSELLER and/or AGENT, for all the Purchaser’s PURCHASER's obligations under this agreement, including damages, and renounces the benefits of division and excussion.

NOMINEE. 23.1 The Purchaser PURCHASER shall be entitled, by notice in writing to the SellerSELLER, to nominate a duly authorized nominee in his place as Purchaser, upon the following terms and conditions:as 23.1.1 the 9.1 The aforesaid notice shall be handed to the Seller SELLER by not no later than 24h00 close of business on the same day as the acceptance date by the SellerDATE OF AGREEMENT; 23.1.2 9.1.1 the notice shall set out the same name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇;PURCHASER: 23.1.3 9.1.2 the notice shall be accompanied by the nominee’s written acknowledgement: 23.1.4 that 9.1.2.1 That it is fully aware of all the terms and conditions of this agreement Agreement as if fully set out in such written acknowledgement; and 23.1.5 that 9.1.2.2 That it is bound by the provisions of this agreement Agreement as the PurchaserPURCHASER; 23.2 9.2 Should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 9.2.1 all reference references to the Purchaser PURCHASER in this agreement Agreement shall be deemed to be a reference to its nominee; and 23.2.2 9.2.2 the Purchaser PURCHASER by his signature hereto, ▇▇▇▇▇▇ interposes and binds ▇▇▇▇▇ himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour of the SellerSELLER, for all the Purchaser’s PURCHASER’S obligations under this agreement, including damages, and renounces the benefits of division and execution.

NOMINEE. 23.1 The Purchaser PURCHASER shall be entitled, by notice in writing to the SellerSELLER, to nominate a nominee in his place as PurchaserPURCHASER, upon the following terms and conditions: 23.1.1 18.1. the aforesaid notice shall be handed to the Seller SELLER by not later than 24h00 on the same day as the acceptance date by the SellerSELLER; 23.1.2 18.2. the notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇PURCHASER; 23.1.3 18.3. the notice shall be accompanied by the nominee’s written acknowledgement: 23.1.4 18.3.1. that it is fully aware of all the terms and conditions of this agreement these Rules of Auction as if fully set out in such written acknowledgement; and 23.1.5 18.3.2. that it is bound by the provisions of this agreement these Rules of Auction as the PurchaserPURCHASER; 23.2 Should 18.4. should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 18.4.1. all reference to the Purchaser PURCHASER in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 18.4.2. the Purchaser PURCHASER by his signature hereto, ▇▇▇▇▇▇ hereby interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour of the SellerSELLER, for all the Purchaser’s PURCHASER'S obligations under this agreement, including damages, and renounces the benefits of division and excussion.

NOMINEE. 23.1 The Purchaser PURCHASER shall be entitled, by notice in writing to the SellerSELLER, to nominate a nominee in his place as PurchaserPURCHASER, upon the following terms and conditions: 23.1.1 13.1 the aforesaid notice shall be handed to the Seller SELLER by not no later than 24h00 close of business on the same day as the acceptance date by the SellerDATE OF ACCEPTANCE; 23.1.2 13.2 the notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇;as 23.1.3 13.3 the notice shall be accompanied by the nominee’s 's written acknowledgement: 23.1.4 13.3.1 that it is fully aware of all the terms and conditions of this agreement as if fully set out in such written acknowledgement; and 23.1.5 13.3.2 that it is bound by the provisions of this agreement as the Purchaser;the 23.2 13.4 Should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 13.4.1 all reference references to the Purchaser PURCHASER in this agreement shall be deemed to be a reference to its nominee; andand DRAFT 23.2.2 13.4.2 the Purchaser PURCHASER by his signature hereto, ▇▇▇▇▇▇ hereby interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour of the SellerSELLER, for all the Purchaser’s PURCHASER'S obligations under this agreement, including damages, and renounces the benefits of division and excussion.

NOMINEE. 23.1 The Purchaser PURCHASER shall be entitled, by notice in writing to the SellerSELLER, to nominate a nominee in his place as PurchaserPURCHASER, upon the following terms and conditions: 23.1.1 20.1. the aforesaid notice shall be handed to the Seller SELLER by not later than 24h00 on the same day as the acceptance date by the SellerSELLER; 23.1.2 20.2. the notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇;as 23.1.3 20.3. the notice shall be accompanied by the nominee’s written acknowledgement: 23.1.4 20.3.1. that it is fully aware of all the terms and conditions of this agreement these Conditions of Sale as if fully set out in such written acknowledgement; and 23.1.5 20.3.2. that it is bound by the provisions of this agreement these Conditions of Sale as the PurchaserPURCHASER; 23.2 Should 20.4. should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 20.4.1. all reference to the Purchaser PURCHASER in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 20.4.2. the Purchaser PURCHASER by his signature hereto, ▇▇▇▇▇▇ interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour of the SellerSELLER and/or AGENT, for all the Purchaser’s PURCHASER's obligations under this agreement, including damages, and renounces the benefits of division and excussion.

NOMINEE. 23.1 16.1 The Purchaser PURCHASER shall be entitled, by notice in writing to the SellerSELLER, to nominate a nominee in his place as PurchaserPURCHASER, upon the following terms and conditions: 23.1.1 the 16.2 The aforesaid notice shall be handed to the Seller SELLER by not later than 24h00 on the same day as the acceptance date by the SellerSELLER; 23.1.2 the 16.3 The notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇;PURCHASER. 23.1.3 the 16.4 The notice shall be accompanied by the nominee’s written acknowledgement: 23.1.4 16.4.1 that it is fully aware of all the terms and conditions of this agreement these Rules of Auction as if fully set out in such written acknowledgement; and 23.1.5 that 16.4.2 That it is bound by the provisions of this agreement these Rules of Auction as the Purchaser;PURCHASER. 23.2 16.4.3 Should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 all 16.4.4 All reference to the Purchaser PURCHASER in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 the Purchaser 16.4.5 The PURCHASER by his signature hereto, ▇▇▇▇▇▇ interposes and binds himself as surety and co-co- principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour of the SellerSELLER, for all the Purchaser’s PURCHASER'S obligations under this agreement, including damages, and renounces the benefits of division and excussion.

NOMINEE. 23.1 The Purchaser PURCHASER shall be entitled, by notice in writing to the SellerSELLER, to nominate a nominee in his place as PurchaserPURCHASER, upon the following terms and conditions: 23.1.1 18.1 the aforesaid notice shall be handed to the Seller SELLER by not later than 24h00 on the same day as the acceptance date by the SellerSELLER; 23.1.2 18.2 the notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇;as 23.1.3 18.3 the notice shall be accompanied by the nominee’s written acknowledgement: 23.1.4 18.3.1 that it is fully aware of all the terms and conditions of this agreement Deed of Sale as if fully set out in such written acknowledgement; and 23.1.5 18.3.2 that it is bound by the provisions of this agreement Deed of Sale as the PurchaserPURCHASER; 23.2 Should 18.4 should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 18.4.1 all reference to the Purchaser PURCHASER in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 18.4.2 the Purchaser PURCHASER by his signature hereto, ▇▇▇▇▇▇ hereby interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour of the SellerSELLER and/or AGENT, for all the Purchaser’s PURCHASER'S obligations under this agreement, including damages, and renounces the benefits of division and excussion.

NOMINEE. 23.1 The Purchaser PURCHASER shall be entitled, by notice in writing to the SellerSELLER, to nominate a nominee in his place as PurchaserPURCHASER, upon the following terms and conditions: 23.1.1 9.1 the aforesaid notice shall be handed to the Seller SELLER by not no later than 24h00 close of business on the same day as the acceptance date by the SellerDATE OF ACCEPTANCE; 23.1.2 9.2 the notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇;PURCHASER: 23.1.3 9.2.1 the notice shall be accompanied by the nominee’s 's written acknowledgement: 23.1.4 that 9.2.1 That it is fully aware of all the terms and conditions of this agreement as if fully set out in such written acknowledgement; and 23.1.5 that 9.2.2 That it is bound by the provisions of this agreement as the PurchaserPURCHASER; 23.2 9.3 Should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 9.3.1 all reference references to the Purchaser PURCHASER in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 9.3.2 the Purchaser PURCHASER by his signature hereto, ▇▇▇▇▇▇ hereby interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour of the SellerSELLER, for all the Purchaser’s PURCHASER'S obligations under this agreement, including damages, and renounces the benefits of division and excussion.

NOMINEE. 23.1 The Purchaser PURCHASER shall be entitled, by notice in writing to the SellerSELLER, to nominate a nominee in his place as PurchaserPURCHASER, upon the following terms and conditions: 23.1.1 13.1 the aforesaid notice shall be handed to the Seller SELLER by not no later than 24h00 close of business on the same day as the acceptance date by the SellerDATE OF ACCEPTANCE; 23.1.2 13.2 the notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇;as 23.1.3 13.3 the notice shall be accompanied by the nominee’s 's written acknowledgement: 23.1.4 13.3.1 that it is fully aware of all the terms and conditions of this agreement as if fully set out in such written acknowledgement; and 23.1.5 13.3.2 that it is bound by the provisions of this agreement as the Purchaser;the 23.2 13.4 Should the Purchaser PURCHASER nominate a nominee in terms of this clause, then: 23.2.1 13.4.1 all reference references to the Purchaser PURCHASER in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 13.4.2 the Purchaser PURCHASER by his signature hereto, ▇▇▇▇▇▇ hereby interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as PurchaserPURCHASER, to and in favour of the SellerSELLER, for all the Purchaser’s PURCHASER'S obligations under this agreement, including damages, and renounces the benefits of division and excussion.

NOMINEE. 23.1 21.1 The Purchaser shall be entitled, by notice in writing to the Seller, to nominate a nominee in his place as Purchaser, upon the following terms and conditions: 23.1.1 21.1.1 the aforesaid notice shall be handed to the Seller by not later than 24h00 on the same day as the acceptance date by the Seller; 23.1.2 21.1.2 the notice shall set out the name and address of the nominee so nominated as ▇▇▇▇▇▇▇▇▇; 23.1.3 21.1.3 the notice shall be accompanied by the nominee’s written acknowledgement: 23.1.4 21.1.3.1 that it is fully aware of all the terms and conditions of this agreement as if fully set out in such written acknowledgement; and 23.1.5 21.1.3.2 that it is bound by the provisions of this agreement as the Purchaser; 23.2 21.2 Should the Purchaser nominate a nominee in terms of this clause, then: 23.2.1 21.2.1 all reference to the Purchaser in this agreement shall be deemed to be a reference to its nominee; and 23.2.2 21.2.2 the Purchaser by his signature hereto, ▇▇▇▇▇▇ interposes and binds himself as surety and co-principal debtor in solidum, for and on behalf of all the obligations of the aforesaid nominee as Purchaser, to and in favour of the Seller, for all the Purchaser’s obligations under this agreement, including damages.
