Common use of Non-Bargaining Unit Positions Clause in Contracts

Non-Bargaining Unit Positions. If an employee accepts a position with the Employer which is not included in the bargaining unit, and thereafter within six (6) months, returns to a position within the bargaining unit by the posting procedures of Article VII. Senioirity accumulated in the bargaining unit position will be frozen at time of departure. Employees under the above circumstances shall retain all rights previously accrued in the bargaining unit for the purpose of any benefits provided in this Agreement.

Senioirity , the employee shall have accumulated seniority in the seniority classification of the bargaining unit from which the employee left for the time worked in the position will be frozen at time of departurenot within the bargaining unit.
