NON-DISCRIMINATION IN SERVICES. In the performance of this Contract CONTRACTOR shall not discriminate in the delivery of Services as provided in CONTRACTOR’s Plan of Operations and Program Statement, attached hereto as Exhibit A-13, on the basis of race, religion, color, creed, national origin, sex, sexual orientation, age, condition of physical or mental handicap, marital status or political affiliation. CONTRACTOR shall comply with the Civil Rights Act of 1964, Government Code Section 11135 and all other applicable laws and regulations, in addition to complying with the CONTRACTOR’s CDSS, CCLD license. COUNTY and CONTRACTOR agree that CONTRACTOR will accept or reject children for placement consistent with CONTRACTOR’s Plan of Operations and Program Statement and in compliance with CONTRACTOR’s license. Such determination may not be arbitrary and capricious, unreasonable or discriminatory.
