Common use of Non-Disturbance Clause in Contracts

Non-Disturbance. With respect to Security Devices entered into by Lessor after the execution of this Lease, Lessee's subordination of this Lease shall be subject to receiving a commercially reasonable non-disturbance agreement (a "Non-Disturbance Agreement") from the Lender which Non-Disturbance Agreement provides that Lessee's possession of the Premises, and this Lease, including any options to extend the term hereof, wii! not be disturbed so iong as Lessee is not in Breach hereof and attorns to the record owner of the Premises. Further, within 60 days after the execution of this Lease, Lessor shall use its commercially reasonable efforts to obtain a Non-Disturbance Agreement from the holder of any preexisting Security Device which is secured by the Premises. In the event that Lessor is unable to provide the Non-Disturbance Agreement within said 60 days, then Lessee may, at Lessee's option, directly contact Lender and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement.

With respect to Security Devices entered into by Lessor after the execution of this Lease, Lessee's subordination of this Lease shall be subject to receiving a commercially reasonable non-disturbance agreement in the form of Exhibit B attached hereto or some other commercially reasonable form approved by Lessee, such approval not to be unreasonably withheld (a "NonNON-Disturbance AgreementDISTURBANCE AGREEMENT") from the Lender which Non-Disturbance Agreement provides that Lessee's possession of the Premises, and this Lease, including any options to extend the term hereof, wii! In the event that Lessor is unable to provide the Non-Disturbance Agreement within said 60 days, then Lessee may, at Lessee's option, either directly contact Lender Lessor's lender and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement, or terminate this Lease upon written notice to Lessor.

With respect to Security Devices entered into by Lessor Landlord after the execution of this Lease, LesseeTenant's subordination of this Lease shall be subject to receiving a commercially reasonable non-disturbance agreement (a "Non-Disturbance Agreement") from the Lender which Non-Disturbance Agreement provides that LesseeTenant's possession of the Premises, and this Lease, including any options to extend the term hereof, wii! will not be disturbed so iong long as Lessee Tenant is not in Breach hereof and attorns to the record owner of the Premises. Further, within 60 days after the execution of this Lease, Lessor Landlord shall use its commercially reasonable efforts to obtain a Non-Disturbance Agreement from the holder of any preexisting pre-existing Security Device which is secured by the Premises. In the event that Lessor Landlord is unable to provide the Non-Disturbance Agreement within said 60 days, then Lessee Tenant may, at LesseeTenant's option, directly contact Lender and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement.
