Non Liability and Indemnification. ORTHOSUPPLY MANAGEMENT shall not be liable for any claim, injury, demand or judgment based on tort or other grounds (including warranty of merchantability) arising out of the sale, compounding, and dispensing of any Prescription. COMPANY agrees to defend, indemnify, and hold ORTHOSUPPLY MANAGEMENT harmless from and against any and all such claims, injuries, demands and judgments, including, without limitation, payment of all costs and reasonable attorneys’ fees.
