Common use of Non-Payment Penalty Exceptions Clause in Contracts

Non-Payment Penalty Exceptions. Members exempt from cost-sharing pursuant to Section 4.1.4 shall not be subject to any of the non-payment penalties set forth in Section 4.7. In addition, certain members will be exempt from program disenrollment due to non-payment as set forth in Section 4.7.1.1. In addition, Section 4.7.1.2 sets forth exceptions to the six month member lock-out after a member has been disenrolled from the program in accordance with Section 4.7. The Contractor is responsible for informing members of these non-payment penalty exceptions as detailed in Sections 4.7 and 7.4. Refer to the HIP MCE Policies and Procedures Manual for specific information related to the non-payment penalty exceptions.
