Noncomplying Licensed Software. In the event the Licensed Software does not perform in all material respects as described in the Documentation, during the one-year period specified above, DOD will notify Publisher and Publisher will have ten (10) business days thereafter to begin remedying the nonconformance. If Publisher is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Licensed Software and Publisher shall promptly refund any moneys paid for such Noncomplying Licensed Software.
