Common use of Noninterference in Band Affairs Clause in Contracts

Noninterference in Band Affairs. Manager agrees not to interfere in or attempt to wrongfully influence the internal affairs or government decisions of the Band government by offering cash incentives, by making written or oral threats to the personal or financial status of any person, or by any other action, except for actions in the normal course of business of Manager that relate to the Enterprise. For the purposes of this ss.10.4.1, if any such undue interference in Band affairs is alleged by the Pokagon Council and the NIGC finds that Manager has unduly interfered with the internal affairs of the Band government and has not taken sufficient action to cure and prevent such interference, that finding of interference shall be grounds for termination of the Agreement. Manager shall be entitled to immediate written notice and a complete copy of any such complaint to the NIGC.
