Nonwaiver of Defaults. Failure of Owner or Contractor at any time or from time to time to enforce or require strict observance and performance of any term or condition of this Agreement will not constitute a waiver of, or affect, or impair such term or condition in any way; nor will such failure affect the right of either party to avail itself at any time of such remedies as it may have for any breach or breaches of such terms or conditions by the other party.
