Common use of Note Documents Clause in Contracts

Note Documents. The Company shall have duly executed and delivered to each Investor, and filed with the appropriate governmental authority, as applicable, the following Note Documents: (i) This Agreement; (ii) A copy of the Indenture executed by the Company and the other parties thereto; and (iii) The Note issued to Cede & Co. hereunder at the Closing to be held beneficially by Cede & Co. on behalf of such Investor.
