Notice and Acknowledgment. A Notice and Acknowledgment, executed by the applicable Borrower Subsidiary for each Additionally Financed Aircraft and the applicable Lessee, with respect to each of the related Additional Leases;

Notice and Acknowledgment. In accordance with California Statutes, the foregoing paragraph does not require Employee to assign or offer to assign to Employer any of Employee's rights in an Invention that Employee developed entirely on Employee's own time without using Employer's equipment, supplies, facilities or trade secret information, and (a) that does not relate directly to Employer's business or to Employer's actual or demonstrably anticipated research or development, or (b) that does not result from any work performed by Employee for Employer. For the purpose of this Section, "Employer's business" shall be defined as development pertaining to implantable medical devices to treat obesity or devices to apply signals to a vagus nerve to treat a gastrointestinal disorder (e.g., obesity, pancreatitis or irritable bowel syndrome). To the extent a provision in this Agreement purports to require Employee to assign Inventions otherwise excluded by this paragraph, the provision is against the public policy of the State of California and is unenforceable. By signing this Agreement, Employee acknowledges receipt of the notification required by California Statutes. ​

Notice and Acknowledgment. Regarding COVID-19 A) Licensee understands that, although San Francisco State University has taken and will continue to take various measures to protect against exposure in accordance with federal, state and local health authorities’ mandates and guidelines, those measures will not eliminate all risk, and thus there will remain a risk of exposure to COVID-19. B) By assuming occupancy, Licensee certifies that, to the best of Licensee’s knowledge, Licensee is not infected with COVID-19. The Licensee will comply with the COVID-19 Policies and Procedures, including any COVID-19 mitigation measures that may be applicable prior to move-in and after move-in. C) By assuming occupancy, Licensee certifies that Licensee is not experiencing symptoms associated with COVID-19. Symptoms may include, but are not limited to, a loss of taste or smell, fever, severe headaches, severe fatigue or body/muscle aches, unusual gastrointestinal distress, and/or signs of respiratory illness, such as a dry cough, shortness of breath, or difficulty breathing. D) By assuming occupancy, Licensee certifies that, to the best of Licensee’s knowledge, within the immediately preceding 14 days of initially assuming occupancy, Licensee has not been in personal or close contact (within six feet for a total of fifteen minutes or more) with an individual infected with COVID-19.

Notice and Acknowledgment. On behalf of the Fund and each Portfolio, notice by the Fund is hereby given and the Custodian hereby acknowledges that (i) the Agreement is executed on behalf of the Fund by authorized officers of the Fund in their capacity as officers and not individually and (ii) any obligation of the Fund hereunder is binding only upon the assets of the Fund (or the applicable Portfolio hereof) and shall not be binding upon any trustees, officer, employee or agent of the Fund or any shareholder of a Portfolio individually.

Notice and Acknowledgment. 3.1 The Subscriber notifies each of the other parties of the novation referred to in clause 2. 3.2 Each of the other parties consents to the novation referred to in clause 2 and acknowledges receipt and sufficiency of the notification given by the Subscriber in clause 3.1.
