Common use of Notices to Proceed Clause in Contracts

Notices to Proceed. Contractor shall not perform the Services set forth in Part III, Appendix B, the Scope of Services, without first receiving a written notice from the Trust to proceed to perform specific scopes of work as described in such notices to proceed. The written notices to proceed may be provided by letter or as an email by the Trust. The Contractor understands that proceeding with the Services is subject to the Trust’s continuing to hold an agreement with the New York State Department of Transportation to reimburse the Trust its costs under this Contract and thus Services shall only be performed upon written approval by the Trust (which can be by email) authorizing the Contractor to proceed with the Services.
