Notification of Discretionary Waivers. Notice has been provided to the Commission regarding discretionary waivers, if any, approved by the Secretary. The School will update this list as needed8. The School shall be entitled to implement all mandatory waivers as contemplated pursuant to NMSA 1978, §22-8B-5(C) without notice to the Commission.

A. If the School believes that the CSD has conducted an annual site visit in a manner that is outside the scope of the Commission-approved annual site visit protocol or in a manner inconsistent with the Commission Rule, the School may provide written notice of the site visit objection to the CSD, with a copy of the notice to Chair, within sixty days after it first receives the Phase 1 annual report, identify the impact of the site visit objection on the Phase 1 annual report and request the action that the School is asking CSD to take to remedy the site visit objection. If the issue is not resolved between the School and CSD within 15 days, the School may provide written notice to the Commission
