Notification to Individuals. In the event Contractor notifies the EA of a Breach in accordance with Article II, Section 11 of this DPA, the EA, and not Contractor, is solely responsible providing any required notice to the affected individuals, Students, Parents, teachers, principals, and relevant authorities, or as may be required by the New York Education Law and its corresponding regulations. Where a Breach of PII occurs that is attributable to Contractor, Contractor shall pay for or promptly reimburse the EA for the full cost of the EA’s notification to Parents, Eligible Students, teachers, and/or principals, in accordance with Education Law Section 2-d and 8 NYCRR Part 121.
