Common use of Notwithstanding Article11 Clause in Contracts

Notwithstanding Article11. 2.1, the Power Producer shall be obliged to serve a notice to Procurer if it is beneficially affected by a Change in Law. Without prejudice to the factor of materiality or other provisions contained in this PPA, the obligation to inform Procurer contained herein shall be material. However, in case the Power Producer has not provided such notice, Procurer shall have the right to issue such notice to the Power Producer.
