Notwithstanding Section IV.H Clause Samples

The "Notwithstanding Section IV.H" clause serves to establish that the provisions within the current section take precedence over any conflicting terms found in Section IV.H of the agreement. In practice, this means that if there is any inconsistency between what is stated here and what is outlined in Section IV.H, the terms of this section will override those of Section IV.H. This clause is commonly used to resolve potential conflicts between different parts of a contract, ensuring that the parties' intentions in the current section are honored even if they contradict earlier provisions.
Notwithstanding Section IV.H. 9.d, a Settling State can become re- eligible for Incentive Payment D if the lawsuit that survived a Threshold Motion is dismissed pursuant to a later motion on grounds included in the Threshold Motion, in which case the Settling State shall be eligible for any missed payments of Incentive Payment D in the following Payment Year, less any litigation fees and costs incurred by CVS in the interim, except that if the dismissal motion occurs after the completion of opening statements in such action, the Settling State shall not be eligible for Incentive Payment D.
