Common use of NYSERDA’s Rights, Title and Interest in ORECs Clause in Contracts

NYSERDA’s Rights, Title and Interest in ORECs. The right, title, and interest to the ORECs NYSERDA is acquiring under this Agreement shall include perpetual and exclusive rights to such ORECs and the underlying Environmental Attributes, including but not limited to the exclusive rights to claim or represent, consistent with New York State Environmental Disclosure Rules: (i) that the energy associated with ORECs was generated by the Selected Project; and (ii) that New York State and/or the Offshore Wind Standard is responsible for the environmental benefits, including reductions in emissions and/or other pollution or any other environmental benefit resulting from the generation of the energy associated with the ORECs.
