Common use of OBLIGATION OF THE OPERATOR Clause in Contracts

OBLIGATION OF THE OPERATOR. (i) The Operator shall, at its own costs and expenses, receive the Subscribed Channels from designated satellites and retransmit the Subscribed Channels to the Subscribers through its digital Addressable System, either directly or through local cable operators. (ii) The Operator shall raise monthly invoices on the Subscribers towards subscription of the channels (from amongst the Subscribed Channels) and the Operator shall collect such invoiced monthly fees from the Subscribers. (iii) Irrespective of the Operator‟s collection of the invoiced monthly amounts from the Subscribers, the Operator shall pay the Monthly License Fees to SDSPL, in a timely manner. (iv) The Operator shall ensure retransmission of high quality encrypted signal of the Subscribed Channels to the Subscribers. (v) The Operator shall take all necessary action to prevent unauthorized access of the Subscribed Channels through its digital Addressable System and shall regularly provide to SDSPL with updated piracy reports. (vi) The Operator shall ensure that no Subscribed Channel shall be disadvantaged or otherwise treated less favorably by Operator with respect to competing channels on a genre basis.
