Common use of Obligation of the Purchasers Clause in Contracts

Obligation of the Purchasers. The Company hereby acknowledges and agrees that no Purchaser shall have any obligation to purchase the Securities or otherwise consummate the transactions contemplated by this Agreement if any of the conditions described in Section 4 have not been satisfied to such Purchaser’s satisfaction or waived by such Purchaser on or prior to the Closing Date.

Obligation of the Purchasers. The Company hereby acknowledges and agrees that no Purchaser shall have any obligation to purchase the Securities or otherwise consummate the transactions contemplated by this Agreement or Amendment No. 1 to Credit Agreement if any of the conditions described in Section 4 7 have not been satisfied to such Purchaser’s satisfaction or waived by such Purchaser on or prior to the Closing Date.
