Common use of Official Information Requests Clause in Contracts

Official Information Requests. [The Recipient shall immediately inform the Ministry of any request received by it for information under the Official Information Act 1982 (OIA) or the Local Government Official Information and Meetings Act 1987 (LGOIMA).] The Recipient shall immediately transfer to the Ministry any request received by it for information under the Official Information Act 1982 in relation to this Deed and shall advise the person requesting the information of such transfer. [If the information to which a request for information under the LGOIMA relates to is more closely connected with the functions of the Ministry than the functions of the Recipient, the Recipient shall immediately transfer to the Ministry the request and shall advise the person requesting the information.] The Recipient shall mark clearly all commercially sensitive information as commercially sensitive when the Recipient provides that information to the Ministry. The Ministry will use reasonable endeavours to advise the Recipient of any request received by it under the OIA that relates to the Recipient’s commercially sensitive information.
