OPERABLE UNIT(S) Clause Samples
The "Operable Unit(s)" clause defines specific geographic areas or segments within a larger site that are treated as distinct units for the purposes of environmental investigation, remediation, or management. In practice, this clause identifies which portions of a property or site are subject to particular obligations, such as cleanup activities or monitoring, and may reference maps or legal descriptions to delineate boundaries. By segmenting a site into operable units, the clause allows for targeted action and clearer allocation of responsibilities, thereby streamlining environmental management and ensuring that each area receives appropriate attention based on its unique conditions.
OPERABLE UNIT(S). Pursuant to the published schedules and timetables, the DOE agrees to develop operable unit(s). After con sultation with EPA and SCDHEC, the DOE shall submit its proposed operable unit(s) to EPA and SCDHEC. The Parties shall make a final selection of the operable units for the site. If the Parties are unable to agree upon the selection of operable units, the final selection of operable unit(s) shall be subject to dispute resolution accor ding to the requirements of Section XXVII (Resolution of Disputes) of this Agreement. The designation of operable unit(s) shall be reviewed and revised annually in conjunction with the preparation and submittal of Appendix C (RCRA/CERCLA Units) of this Agreement. All submittals and elements of work undertaken pursuant to this Section shall be performed in accor dance with the requirements and time schedules set forth in Section XX (Timetables and Deadlines) of this Agreement. Operable unit(s) shall meet the purposes set forth in Section III (Purposes of Agreement) of this Agreement.
OPERABLE UNIT(S). 9.2.1 USACE shall develop, implement, and report on Remedial Investigations and Feasibility Studies (RI/FSs) for the Operable Units listed in the Findings of Fact, Section VI, above, and new Operable Units established under Subsection 9.2.
OPERABLE UNIT(S). Finding of Fact 6.19 finds that data is needed to do a supplemental remedial investigation, updated baseline Risk Assessment and revised upland and river feasibility studies. However, this section only requires RI/FS, with no mention of an updated baseline risk assessment. That should be included. Specifying in the Bradford FFA that a risk assessment must be done is not necessary because baseline risk assessments are to be part of every remedial investigation (RI) according to the NCP, 40 CFR § 300.430(d)(4). Also, Section 9.2.6 of the Bradford Island FFA calls for a Baseline Risk Assessment to be performed as part of the RI. No change is necessary for the Bradford Island FFA based on this comment.

DOE agrees that a proposed designation of RODs for OUs (OUs), including, as appropriate, OUs carved out from previously- identified Potential OUs, shall be included in its annual Site Management Plan. The Parties shall make selections of the OUs for the Site, annually, in accordance with Section XVIII (Site Management, Timetables and Deadlines, Budget Planning and Execution, Cost and Productivity Savings) of this Agreement, or as appropriate to support a bias for early response actions, as described in Section XIV.B of this Agreement. OUs may incorporate other OUs for which remedies have already been selected in a ROD, where appropriate (i.e., Comprehensive Site OU, RODs containing final remedy decisions following Interim RAs) to ensure that multiple remedies continue to be protective of human health and the environment. OU(s) and Potential OUs shall meet the purposes set forth in Section III (Purposes of Agreement) of this Agreement.
OPERABLE UNIT(S). Completion of OUs is required to achieve delisting of the site from the NPL and the decommissioning of the gaseous diffusion plant (GDP). Prior to final deletion from the NPL, partial delisting may occur if conditions are met to support potential property transfers. Appendix 3 includes additional information regarding scope for each of the defined OUs. This scope has been left in place; however, additional information on the integration and acceleration of cleanup has been included in Appendix 3. OPERABLE UNIT(S). The Site shall be segregated into Potential OUs and CS OUs for the purpose of scoping and planning RI/FS activities. Potential OUs shall be developed for source areas and CS OUs shall be developed for environmental media contaminated by commingled source releases. OUs for Interim or final RAs may be designated for all or any portion of a Potential OU or CS OU.
OPERABLE UNIT(S). Contaminated groundwater and vapor intrusion from contaminated groundwater are the primary public health concerns at the present time for the Site. Determining the fate and transport of the PCE Plume will be the focus of the second, groundwater, Remedial Investigation (RI) for Operable Unit – 2 (OU-2). Ecological concerns will also be considered during all Site RIs. Based on the public health concerns related to indoor air inhalation exposure to PCE and its breakdown products, VA chose to address this concern first and has implemented an accelerated operable unit (AOU - 1) for the ESS. PCE contamination in shallow groundwater may lead to vapor intrusion by PCE and its degradation products, trichloroethene, cis-1,2 dichloroethene, trans- 1,2 dichloroethene, and vinyl chloride, into nearby homes, schools and businesses where contaminated groundwater is within 50 feet of the ground surface if: 1) a viable vapor pathway exists in the soils and/or groundwater underlying the Site; and 2) nearby buildings are vulnerable to vapor intrusion. Sampling has shown that several springs and seeps in the ESS are contaminated with PCE and/or one of its degradation products. Exposure to PCE in air over a prolonged period of time can cause both acute and chronic health problems. Indoor air screening levels have been established based on EPA’s Regional Screening Levels for PCE and its degradation products. The other primary health risk concern is Salt Lake City’s drinking water. In 2004 SLC Well 18, located on ▇▇▇ ▇▇▇▇▇ ▇▇▇▇▇▇, near the intersection with Guardsman Way, was sampled and laboratory results showed contamination by PCE. While the level was below the National Drinking Water Act Maximum Contaminant Level (MCL) for PCE, the well was shut down as a precaution to ensure a safe water supply. Samples from the nearby Mt. Olivet irrigation well, which is near SLC Well 18 continue to exceed the federal drinking water standards. Although PCE has been detected in the springs, the drinking water for this area is supplied by the SLC municipal water system and the water is safe to drink. VA will investigate and attempt to locate the sources(s) of PCE contamination, its effect on groundwater, the extent of the groundwater contamination and remedial options in a second operable unit (OU-2). VA will evaluate the need for additional OUs based on the results of AOU-1 and OU-2 and may, at a later date, establish them to further address the impacts to the Site.
OPERABLE UNIT(S). 9.2.1 VA shall develop, implement and report on Remedial Investigations and Feasibility Studies (RI/FSs) for the 700 S 1600 E PCE Plume Site, including potential sources of the contamination at the Site, and any Operable Units established under Subsection 9.2.
