Operation of Services. 2.1 Contractor’s Performance and Related Obligations
Operation of Services. The services to be performed by the Contractor pursuant to this Agreement are: (1) Actual dispatch and operation of the Fixed Route community circulators and Dial-A-Ride/ADA Paratransit buses and, (2) submission of reports and other materials to VCTC as specified within this Agreement. All operations will be carried out in accordance with California, DOT and FTA regulations and Title VI non-discrimination laws. Contractor will operate transit service in a safe, courteous, reliable manner as specified by VCTC and in strict accordance with the operating days and hours, routes and schedules set forth in the current VCTC brochures or any revisions thereto in writing. Notwithstanding the above, Contractor will be authorized to deviate from established routes when necessary to avoid construction, detours, or other obstruction within the public right of way, or conditions which otherwise would cause an unsafe condition or operation of the service. Contractor shall notify VCTC of such obstruction causing deviation as soon as is practicable upon learning the deviation may become necessary.

The Service Provider shall provide a vehicle of sufficient seating capacity with a driver and a passenger assistant (where requested) to provide the Services specified by the Council, on every day required for each Call-Off Contract between the Council and the Service Provider.

You understand that: (a) the Alarm Monitoring communications are provided over one or more transmission systems, as determined by Polar in its sole discretion, such as POTS (plain old telephone system), VoIP, DSL, broadband, cellular, radio, Internet, etc.; (b) transmission systems are maintained and serviced solely by the applicable transmission system provider, which may include an affiliate of the Company with respect to certain YOU UNDERSTAND THAT POLAR AND/OR ANY OF ITS AFFILIATES, VENDORS, OR AGENTS, INCLUDING ANY ALARM MONITORING SUBCONTRACTOR, WILL NOT RECEIVE SIGNALS FROM THE ALARM / HOME SECURITY EQUIPMENT IF YOUR TRANSMISSION SYSTEMS ARE NOT WORKING PROPERLY, TRANSMISSIONS ARE INTERRUPTED FOR ANY REASON, OR IF CHANGES IN THE TRANSMISSION SYSTEMS PREVENT THE SYSTEM FROM COMMUNICATING WITH THE MONITORING PROVIDER. YOU ARE RESPONSIBLE FOR TESTING THE SYSTEM ON A WEEKLY BASIS, AS WELL AS IMMEDIATELY FOLLOWING ANY STORM, POWER OUTAGE, TRANSMISSION SYSTEM OUTAGE, OR ANY CHANGE TO ANY TRANSMISSION SYSTEM, IN ORDER TO VERIFY THE CONTINUED FUNCTIONING OF THE SYSTEM. LIMITATION OF LIABILITY. YOU ACKNOWLEDGE THAT NEITHER THE COMPANY NOR ITS AFFILIATES, NOR ANY OF ITS OR THEIR AGENTS, REPRESENTATIVES, SUPPLIERS, SERVICE PROVIDERS, CONTRACTORS OR SUBCONTRACTORS IS AN INSURER OF OR AGAINST ANY POTENTIAL OR ACTUAL LOSS OR DAMAGE TO PERSON OR PROPERTY THAT MAY OCCUR IN OR AT THE PREMISES, WHETHER AS A RESULT OF BURGLARY, THEFT, FIRE, SMOKE, CARBON MONOXIDE POISONING, PHYSICAL HARM TO ANY PERSON, ENTRY IN OR ONTO THE PREMISES, THE CONDUCT OF ANY PERSONS IN OR ON THE PREMISES, OR OTHERWISE. YOU ACKNOWLEDGE THAT THE PAYMENTS YOU MAKE UNDER THIS AGREEMENT ARE NOT RELATED TO THE VALUE OF THE PREMISES, YOUR POSSESSIONS, OR THE PERSONS OCCUPYING OR AT ANY TIME PRESENT IN OR ON THE PREMISES, BUT RATHER ARE BASED ON THE COST OF THE SYSTEM AND THE SERVICES, AND TAKE INTO CONSIDERATION THE PROTECTIONS AFFORDED TO COMPANY UNDER THIS AGREEMENT. THE COMPANY EXPRESSLY DENIES AND DISCLAIMS ALL LIABILITY FOR ANY LOSS OR DAMAGE WHICH MAY OCCUR PRIOR TO, AT OR AFTER SIGNING THIS AGREEMENT. THIS INCLUDES LIABILITY BASED ON CONTRACT, TORT, NEGLIGENCE OF ANY DEGREE, WARRANTY (INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) AND ALL OTHER THEORIES OF LIABILITY. Operation of Services. The CVTD has agreed to undertake, perform and complete in an expedient satisfactory and proper manner, the efficient and effective operation of transit service within the City of San ▇▇▇▇▇▇.

You understand that: (a) the Alarm Monitoring communications are provided over one or more transmission systems, as determined by Polar in its sole discretion, such as POTS (plain old telephone system), VoIP, DSL, broadband, cellular, radio, internet, etc.; (b) transmission systems are maintained and serviced solely by the applicable transmission system provider, which may include an affiliate of the Company with respect to certain transmission systems; (c) these transmission systems may be affected by faulty or failed equipment, weather conditions, power outages, upgrade or maintenance work, or other interruptions in service; and (d) any such conditions or changes made to these transmission systems may disrupt Services provided under this Agreement. Without notice from you, Polar, its affiliated operations, and the Alarm Monitoring Subcontractor may not be aware of the existence of any such problem.
Operation of Services. 2.1 The Service Provider shall provide a vehicle of sufficient seating capacity with a driver and a passenger assistant (where requested) to provide the Services specified by the Council, on every day required for each Individual Contract between the Council and the Service Provider.
2.2 The Service Provider must provide a valid and usable telephone number to enable contact during normal office hours, Monday – Friday. At all times the Service Provider must be able to contact drivers.
2.3 The Service Provider must agree specific collection points and boarding/alighting arrangements with the parent and school/college/day centre or other establishment. Any risks in such arrangements should be communicated to the Council’s Contact immediately.
2.4 The Service Provider must inform the Council’s Contact of any changes to the passenger list immediately.
2.5 The Service Provider shall comply with the timetable and route agreed with the Council, including any agreed amendments. After the award of an Individual Contract, the Service Provider will work with the Council’s Contact to identify and introduce improvements to route efficiency and timing.
Operation of Services. 7.1 The Customer acknowledges and agrees that the Instructions for the services shall be processed by SBI only if the same are received by SBI in the prescribed time and manner.
7.2 The Customer agrees and acknowledges that the Services shall be provided by SBI only at the registered communication address of the Customer available with SBI at the time of the Customer applying for availing the Services through the Application. In case of any request provided by the Customer for getting the registered communication address changed in the records of SBI in a manner as may be prescribed by SBI, such changed communication address shall be used by SBI for providing the Services to the Customers.
7.3 SBI shall not be liable for any inaccuracy, error or delay in, or omission of, (1) any data, information or message in the Instructions given over the phone or internet, or (2) the transmission or delivery of any Instructions given by medium of any channel or (3) any loss or damage arising from or occasioned by (i) any such inaccuracy, error, delay or omission, or (ii) interruption in any such data, information or message, due either to any act or omission by SBI due to "force majeure" (e.g., flood, extraordinary weather condition, earthquake or other act of God, fire, war, insurrection, riot, labour dispute, accident, action of government, communications, power failure, equipment or software malfunction) or any other cause beyond the reasonable control of SBI, and in case of tampering and unauthorised access to providing of Instruction, Instructions that are fraudulently or mistakenly written, altered or sent, SBI may, at its sole and absolute discretion, act on any Instruction given by the Customer to SBI, or which SBI reasonably believes to have been made by the Customer. The Customer agrees that SBI shall not be liable if: the Customer has breached any of the Terms, contained herein or the Customer has contributed to or the loss is a result of failure on part of the Customer to advise SBI within a reasonable time about unauthorised access of or erroneous transactions in the Account by use of the Services;
7.4 The Customer agrees and acknowledges that SBI is under no obligation whatsoever to accept an Instruction. Further, without limiting the generality of the foregoing, SBI shall not be deemed to have accepted any Instruction unless and until SBI receives the complete Instruction on a business day and during the normal business hours of SBI, through any of the c...
Operation of Services. The Landlord will do everything reasonable to ensure that the Services operate efficiently except in emergency situations provided always that:
(a) the Landlord will not repair faults outside Landlord’s Working Hours; and
(b) the Tenant may not end this Lease or stop or reduce payments under the Lease because a Service is not available, is interrupted or fails.
Operation of Services. 3.1. In the case where a Schedule provides that Telstra will resell or arrange for the installation and connection of a local circuit, Telstra will (as required) arrange for such installation and connection at a main distribution frame for the Customer’s Premises (the “Connection Point”). Telstra is not responsible for connections or cabling beyond the Connection Point. Telstra may, if requested by the Customer and agreed to by Telstra in writing, arrange for the movement of the Connection Point and/or provide additional cabling or connections on a time and materials basis.
3.2. Telstra may schedule Planned Network Maintenance from time to time. Telstra will use commercially reasonable efforts to give the Customer at least 40 hours notice of Planned Network Maintenance. In the case of emergency repairs or modification, where possible, Telstra will use commercially reasonable efforts to give the Customer 24 hours advance notice of the interruption. Notice under this Section may be given by telephone, email or fax or, where provided to the Customer, online reporting service.
